Terms and Conditions

1. All the content of this site is the property of Indianpurchase.com Infoware Ltd. and any further sale or display of this information to third party or public is illegal.

2. An advertisement will include any online internet publicity service published, produced and/ or generated by the publisher, IndianPurchase.Com Infoware Ltd. (hereinafter named "IPCIL").

3. Advertisement images and materials shall be supplied to us by the advertiser. However these are subject to IPCIL’s approval.

4. Advertisements shall be placed in pre-defined space on the site. Availability and placements of advertisements in specific spaces is the jurisdiction of IPCIL.

5. Images and content can be amended anytime with approval of IPCIL.

6. IPCIL shall post advertisements on receipt of material. IPCIL has the right to refuse to upload an advertisement on it’s site or to cancel a running advertisement contract without giving reason, at any given time.

7. IPCIL’s liability shall not exceed the rate charged by it for the advertisement in question.

8. IPCIL shall take care in hosting advertisements, but it shall not assume any responsibility for errors in text, color, and layout of any advertisement. We are not liable for loss of advertisement material, computer floppies, or any other material submitted for advertisement purpose.

9. It is the advertising companies/ individuals’ responsibility that his/her advertisement does not violate or infringe upon any intellectual property right or rights held by another, including copyright on any material design or graphic. In lieu of IPCIL hosting the advertisement on its site, the advertiser agrees to indemnify, defend, and save IPCIL from all liabilities arising due to the contents (including but not limited, to graphic designs, images, photos, written material, slogans, representations, maps, brand names, trademarks, logos, names, software, any copyrighted material etc.) of advertisements, unauthorised use of a person’s name, photos, software, arising because of IPCIL hosting such an advertisement on the instructions of the advertiser.

10. IPCIL shall from time to time be allowed to send E-mails, newsletters, marketing mailers, and other information regarding our services and products.

11. IPCIL is not liable for delays in hosting an advertisement or text; the delay being caused by an event of act of God, government regulations, natural calamity, strikes, bandwidth shortage, power or material shortage, transportation interruption, work slow down due to circumstances beyond the control of IPCIL.

12. IPCIL shall refuse to host advertisements, text etc. that carries obscene, disgraceful information, display of product. This is to IPCIL’s judgement as to what is considered inappropriate.

13. Material prepared by IPCIL cannot be reproduced without written sanction from IPCIL.

14. The advertiser agrees to pay all legal fees and expenses that may be incurred by IPCIL in defending itself in matters relating to claims or demands made by another party/ parties for damages caused to it by the advertisement hosted by IPCIL on behalf of the advertiser; violation of terms and conditions of this contract, or infringement by the advertiser of intellectual property rights or any other rights or claims by third parties.

15. IPCIL is indemnified against any loss, costs, claims, damages which IPCIL suffers and / or incurs due to the seller and / or buyer not fulfilling his obligations under a contract or/ and agreement that you have concluded for goods and / or services to sell or buy. This indemnity is not limited to any cost, loss, damages, liability arising out of any claim brought against IPCIL by a seller and/ or buyer or another party, by virtue of making online buy/ sell system available to you.

16. IPCIL does not have and does not accept any responsibility / liability to a buyer, seller, or another party to transactions for any loss, direct or indirect, economic, consequential due to a legally binding contract between a seller, buyer, and/ or any other party/ person, where the loss is due to fraud, breach of contract, negligence etc.

17. IPCIL is not liable and claims no responsibility for loss, damage, etc arising out of a negotiation, contract, agreement, purported or executed, between a seller, buyer, or/ and any other party. 18. These terms are binding and take precedence on any other conditions printed or otherwise appearing on contracts, orders etc. if they are conflicting to those mentioned in this contract.
